1. Scope

The following terms and conditions apply to all orders via our online shop.

2. Contractual partner, customer service

The purchase contract is concluded with Nuts Management KG. More information about us can be found in the imprint. You can reach our customer service for questions, complaints and complaints by e-mail or by calling +43 677 62379009.

3. Conclusion of contract

The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog. By clicking the order button, you are placing a binding order for the goods in the shopping cart. The confirmation of the receipt of the order takes place together with the acceptance of the order immediately after sending by an automated email. With this email confirmation, the purchase contract is concluded.

If you choose the payment method SOFORT Überweisung, the contract is in any case concluded at the time the payment order is confirmed by the payment service provider.

If you choose the PayPal payment method, the contract is in any case concluded at the time the payment order is confirmed by the payment service provider.

If you choose the credit card payment method, the contract is in any case concluded at the time the payment order is confirmed by the payment service provider.

The condition for the effective conclusion of a contract is always that the order process is completed when the order is sent.

4. Shipping costs

In addition to the stated product prices, there are also shipping costs. You can find out more about the amount of shipping costs in the orders information. Shipping costs may vary depends on the country.

5. Payment methods

We offer SOFORT transfer, PayPal and credit card as payment methods:

  • SOFORT Überweisung
    You pay as usual using your online banking data with your PIN and TAN.
  • PayPal
    You pay the invoice amount via the online provider PayPal. In principle, you must be registered there or register first, legitimize with your access data and confirm the payment instructions to us (exception, if applicable, guest access). You’ll get more information during the ordering process.
  • Credit card
    You pay the invoice amount with your Visa, MasterCard or Maestro. The data is transmitted in encrypted form and your credit card details are not saved on our server. The processing takes place through our partner stripe.

6. Self pickup

We offer a self collection of the ordered product free of charge.

7. Reservation of ownership

The goods remain our property until full payment.

8. Transport damage

If goods are delivered with obvious transport damage, please report such errors to the deliverer as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to assert our own claims against the carrier or transport insurance.

9. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving a reason.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier has taken possession of the goods.

To exercise the right of withdrawal, you must contact us.

by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of the decision to revoke this contract. You can also electronically fill out and submit the model withdrawal form or another clear declaration on our website. If you make use of this option, we will send you a confirmation of receipt of such a cancellation by email.

In order to meet the cancellation deadline, it is sufficient for you to send your notification that you are exercising your right of cancellation before the cancellation period has expired.

Consequences of cancellation

If you withdraw from the contract, we will give you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from the fact that you have chosen a different type of delivery than the standard delivery offered by us ), to be repaid at the latest within thirty days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you. In no case you will be charged any fees for the repayment.

You have to return the goods to us immediately and in any case no later than fourteen days from the date on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

We pay the costs of returning the goods.

If you cannot return the goods received to us or only partially or only in a deteriorated condition, you must compensate us for the value. You only have to pay compensation for the deterioration of the item and for any benefits drawn if the use or the deterioration is due to handling of the item that goes beyond the examination of the properties and functionality. ‘Checking the properties and functionality’ means testing and trying out the goods in question, as is possible and customary in a retail shop.

The right of withdrawal does not apply to the following contracts:

  • Contracts for the delivery of goods that can spoil quickly or whose expiration date would quickly be exceeded.
  • Contracts for the delivery of sealed goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

11. Place of jurisdiction, applicable law, contract language

  • The language available for the conclusion of the contract is German.
  • The place of jurisdiction and fulfillment is the registered office of the seller if the customer is a merchant, a legal entity under public law or a special fund under public law.
  • The contract language is German.
